Terms and Conditions of usage of airtel money

Customer is required to read the under mentioned terms and conditions carefully. By subscribing for the airtel money service, the Customer acknowledges that the customer has read, understood and agrees to be bound by these terms and conditions.

  1. airtel M Commerce Services Limited (hereinafter referred as AMSL) means a company incorporated under the Companies Act, 1956 with its registered office at Bharti Crescent, 1, Nelson Mandela Road, Vasant Kunj, Phase II, New Delhi - 110070, India.
  2. Customer means a person who has registered with AMSL for availing the airtel money service and who has accepted these Terms and Conditions and, owns a compatible Mobile Phone that supports the airtel money service.
  3. Enrollment Form (hereinafter referred to as airtel money Wallet Application Form) means the request form along with the prescribed Know Your Customer (KYC) documents, as is required by AMSL from the Customer at the time of Registration or on a later date, for availing and / or continuation of the airtel money service.
  4. KYC means Know Your Customer information based on KYC documents furnished by the customers as per the RBI Guidelines.
  5. Services shall mean the airtel money service rendered by AMSL to the customers within the geographical boundaries of India.
  6. Charge(s) or service Charge shall mean the charges which AMSL may charge from the customers in consideration for subscribing for the service.
  7. Stored Value Card Wallet (hereinafter referred as airtel money) means the pre-paid payment instrument issued by AMSL under the Certificate of Authorization granted by the Reserve Bank of India.
  8. Merchant Establishment shall mean and include all merchant locations wherever the airtel money wallet is accepted for the purpose of facilitating a commercial transaction by Customer.
  9. M-PIN means the secret numeric password used by the Customer to effect his/her transactions.

1. Reservations
AMSL reserves the right:
1.1 To seek and/or verify the particulars including the Know Your Customer (KYC) information provided by the customer, either by itself or from independent sources;
1.2 To reject any airtel money Application Form, in case particulars provided therein are incomplete, incorrect or for any other legally just and valid reason. The information provided by the Customer/or gathered by AMSL shall become AMSL’s property even if airtel money Application Form is rejected and AMSL may use the said information for any lawful purpose, subject to the applicable laws and regulations. AMSL has the right to forfeit the amount if the information provided by the customer is found incorrect.
To amend the present Terms and Conditions for the proper provisioning of the Services or to comply with the applicable laws and regulations.

2. Services
2.1 Under the present scheme AMSL may register and activate the Services of the Customer for the following:

  1. Utility Payments (Refer to guidelines available at airtel money Website www.airtelmoney.in or Welcome Kit provided with the application form).
  2. All authorized Merchants (In this case Proof of Identity (POI) and Proof of Address (POA) is required. For the detailed list, please refer www.airtelmoney.in).
  3. All Utility Payments and all Authorized Merchants (In this case only (POI) is required).

For detailed features, registration process, KYC requirements, permitted transactions, closing of Services procedure and other related details relating to the abovementioned Services, the Customer is required to refer www.airtelmoney.in.
2.2 The Customer can load the airtel money Wallet at the airtel money Retailer outlet. For details, please refer to airtel money website (www.airtelmoney.in).
2.3 Customer is not allowed to withdraw cash from airtel money Wallet.
2.4 The airtel money is governed by the Payment and Settlement Systems Act, 2007 & Regulations made there under, Issuance and Operation of Pre-paid Payment Instruments in India (Reserve Bank) Directions, 2009 (“RBI Guidelines”) and instructions issued by the Reserve Bank of India (RBI) from time to time in respect of the same.
2.5 Services are only available to resident Indians who have attained the age of 18 years and are competent to contract.
2.6 Services will be activated upon registration of the Customer, which shall be up to 5 day(s) upon the receipt of the complete Customer information and application. The Services are not transferable.
2.7 The maximum value that can be stored at any point of time in the airtel money Wallet is Rs. 5000/- and the transaction value cannot exceed Rs. 5000 per day and Rs. 50,000 per month. For details of limits related to various Services, please refer www.airtelmoney.in
2.8 AMSL reserves the right to reduce the limit of cash-in to Rs. 5000.
2.9 No redemption, refund, transfer of funds or cash withdrawal is permitted on the airtel money except as per the directions of the RBI, if any.
2.10 The value loaded in the airtel money is valid for a period of one hundred and eighty (180) days from the date of last commercial transaction or for 6 months from the date of activation/issuance to the Customer in case there has been no transaction by the customer. The customer will be given a notice of 15 days prior to expiry date, post which any unutilized balance remaining in the airtel money Wallet after the expiry date shall stand forfeited in favor of AMSL as per the RBI Guidelines.
2.11 Functionality and /or availability of the Services, may be affected and AMSL, without any liability, whatsoever, is entitled to refuse, limit, suspend, vary or discontinue the Services, at any time, for any reasonable cause, including, but not limited, to the following:

  1. any violation by the Customer of the rules, regulations, orders, directions, notifications issued by RBI from time to time;
  2. any discrepancy in the particular(s) provided by the Customer;
  3. to combat potential fraud, sabotage, willful destruction, threat to national security or for any other force majeure reasons etc;
  4. due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons.
  5. transmission limitation caused by topographical and geographical constraints/limitations;
  6. deactivation of the mobile connection of the Customer by the concerned telecom service provider for any reason;
  7. Any other reason, which is found to be reasonable by AMSL warranting limiting/suspension/disconnection of the Services.

2.12 The Services shall be valid till the time it is discontinued by the Customer or AMSL.
2.13 No refund from the airtel money Wallet will be allowed, if the Customer wishes to close / discontinue using Services.
2.14 If the customer is found to hold two or more than two wallets, then AMSL has the right to forfeit the balance in such other wallets.
2.15 If the particulars provided in the Customer KYC documents do not match with details mentioned in the Enrollment Form, then AMSL has the right to forfeit the balance in such wallets.

3. Billing and Payment
3.1 Customer agrees to pay the service Charges as prescribed by AMSL from time to time. AMSL may at its discretion, change, amend, increase, or reduce the service Charges.
3.2 AMSL accepts no responsibility for any charges levied by any Merchant Establishment and debited to the airtel money with the transaction amount.
3.3 For schedule of Charge(s) please refer to the airtel money service welcome pack or company website (www.airtelmoney.in), retailers’ outlet or call the airtel money customer care center.

4. Customer Obligations
4.1 Customer shall have a mobile phone with an active telecom connection.
4.2 Customer shall ensure that at all times the mobile phone number registered by him/her is issued to him/her by the concerned telecom service provider.
4.3 Customer shall ensure that he has sufficient funds in his airtel money Account to take care of transaction amount and related Charges before he initiates the transaction.
4.4 Customer shall ensure that all utility bill payments using the Services should be done at least 5 working days before the actual due date.
4.5 Customer shall be solely responsible for the confidentiality, safety and security of the M-PIN. Customer shall be the sole owner of M- PIN and shall be solely responsible for the consequences arising out of the disclosure of his M-PIN and/or the unauthorised use of the Services. In case the M-PIN of airtel money is lost or misplaced, Customer shall promptly inform AMSL by calling at the customer care numbers. M-PIN will be barred after necessary customer validation and a new M-PIN will be issued.
4.6 Customer shall only use the airtel money for all transactions with the specific Merchant Establishment for the products/services available therein.
4.7 Customer shall intimate AMSL about change in address, if any, in writing along with such proof, as may be deemed necessary by AMSL.
4.8 Customer shall not use the Services for any unlawful, immoral or abusive purposes in violation or derogation of any law/rule or regulation or statutory directive or order for the time being in force or against any public policy.
4.9 Customer agrees that he/she will ensure that he/she neither abates nor is a party to any illegal/criminal/money laundering/terrorist activities undertaken by using this service.
4.10 Customer shall ensure that his/her name does not at anytime appear in the consolidated list of Terrorist Individuals / Organizations as circulated by RBI from time to time.
4.11 Customer acknowledges and understands that the Services are linked to the mobile phone number of the Customer and the Customer is responsible for any liability arising out of the loss/ theft / misuse of the mobile phone number or deactivation of mobile connection by the concerned telecom service provider, in respect of the Services.
4.12 Customer, upon activation of the Services, gives express consent to AMSL to share the KYC information with its related parties for business purposes.
4.13 Customer undertakes and authorizes AMSL/sponsor/affiliate companies to exchange, share or part with all the information, data or documents relating to Customer application to other group and affiliate companies.
4.14 Customer shall ensure that the Services are not used for transactions in foreign currency.
4.15 Customer shall stop using the Services immediately upon termination of the Services for any reason.

5. Confidentiality
5.1 Privacy of communication is subject to the terms of the Certificate of Authorization granted by the RBI and RBI notifications/directives etc. The Customer specifically agrees that in order to facilitate AMSL to provide Services, AMSL may be required to disclose any information or particulars pertaining to the Customer to any authority, statutory or otherwise.
5.2 The user interfaces, graphics, logos, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of the Services provided by the AMSL (the “Materials”) are protected by copyright, designs, patent, and trademark laws, international conventions and other applicable intellectual property and proprietary rights of either AMSL and/or its related Parties.

6. Disclaimer of Liability
6.1 AMSL makes no express or implied warranty, guarantee, representation or undertaking whatsoever regarding the Services, which are not expressly mentioned herein.
6.2 AMSL shall not be responsible for any acts or omissions of any third party including distributors/retailers/merchants etc., with regard to Services which are not expressly authorized by AMSL.
6.3 AMSL shall not be liable to the Customer for any delays, loss of business, profit, revenue or goodwill, anticipated savings, damages, fees costs, expense, etc. or for any indirect or consequential loss, howsoever, it arises for or on account of unavailability/usage of Services or otherwise.
6.4 AMSL shall not be liable to the Customer for injuries or damages resulting from omissions, interruptions, delays, errors in transmission, failures or defects in equipments, or disconnection of the mobile services by the concerned telecom service provider or any other cause including but not limited to the failure to transmit, which are connected with incidents of fire, explosion, war, riots, strikes, lockouts, picketing boycotts, and cause originating in the facilities or operations of other service providers and other reasons or causes beyond the control of AMSL or for any reason whatsoever.
6.5 The terms and conditions herein shall be subject to the notifications/ guidelines issued by RBI, from time to time.
6.6 AMSL shall not in manner be responsible for any disputes regarding goods and services of Merchant Establishment received by the Customer including the quality, quantity, value, warranty, delay of delivery, non delivery, breakage, defect, non receipt of any goods or services.
6.7 AMSL will do its best to ensure that customer transactions and information remain secure and confidential AMSL makes no warranty or representation of any kind in relation to the system and the network or their function or performance or for any loss or damage whenever and howsoever suffered or incurred by the Customer or by any person resulting from or in connection with the use of the Services.

7. Indemnity
Customer agrees to indemnify, save and hold AMSL and/or related parties harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to Customer’s use or misuse of the Services, any violation by Customer of these Terms and Conditions, or any breach of the representations, warranties, and covenants made by the Customer herein.

8. Additional T&Cs
8.1 AMSL reserves the right at anytime to refuse for any reason whatsoever, the use of the Services for the designated Merchant Establishments. Merchant Establishments’ list is dynamic and AMSL may add or delete from the same. It is available in the welcome kit (SUK) and on the website – www.airtelmoney.in
8.2 Any dispute with or complaint against any Merchant Establishment must be directly resolved by the Customer with the Merchant Establishment.
8.3 AMSL may keep its records of the payment transactions in any form. In the event of any dispute, AMSL records shall be binding as the conclusive evidence of the transactions carried out through Services in the absence of clear proof that AMSL records are erroneous or incomplete.

9. Severability
If any part/clause of this airtel money Wallet Application Form becomes illegal, invalid or unenforceable that part/clause shall be ineffective to the extent of such invalidity or un-enforceability only, without in any way affecting the validity or enforceability of the remaining parts of said provision/clause or any other clause/provision of this airtel money Wallet Application Form.

10. Jurisdiction
The Courts at New Delhi shall have exclusive jurisdiction in respect of any dispute regarding the terms and conditions contained in this airtel money Wallet Application Form.
